Twll y Cae Terms and Conditions
By booking accommodation at Twll y Cae (the property) you (the lead guest), are entering a binding contract with me, Ann Alston (the owner), which is subject to the following Terms and Conditions. It is your responsibility to make all of your party aware of these Terms & Conditions.
Booking: The person who makes the booking (lead guest) must be 18 years old or over at the time of booking and must have the authority and undertake responsibility to accept the terms and conditions on behalf of all of the party. Bookings are provisional until I confirm by email or in writing, and I reserve the legal right to refuse a booking. You must provide me with the names and contact details of all your party once the booking is confirmed. You are responsible for checking the booking confirmation and informing me of any errors immediately.
Deposits and payments: A deposit of 25% of the total cost of the booking is required at the time of booking and the balance is due 4 weeks before you are due to arrive. The deposit must be received within 7 days of a booking otherwise the booking will be void. If you book less than 4 weeks before you are due to arrive, you must pay the full cost of the booking at the time of booking. You are responsible for paying the final balance by the due date. I am under no obligation to issue a reminder.
Cancellations and changes by you:
Cancellation due to disinclination to travel or inability to travel including, but not limited to, illness (including Covid 19), family emergency, travel delays, change in circumstances and call to jury duty are deemed to be at your own risk. Purchasing holiday cancellation insurance is strongly recommended.
If you cancel your booking more than 8 weeks before you are due to arrive: I will refund all payment made to me minus a £25 service charge.
If you cancel your booking between 4-8 weeks before you are due to arrive: I will retain your deposit but any further payment you have made to me will be refunded. If I am able to rebook the dates I will refund your deposit minus a £25 service charge
If you cancel your booking less than 4 weeks before you are due to arrive: no refund will be due but if I am able to rebook the dates I will refund all payment made to me minus a £25 service charge.
Cancellation and changes by me: I will try to inform you immediately of any unavoidable changes or circumstances beyond my control that affect your booking. In the unlikely event that I have to cancel your booking, I will refund in full all payment that you have made to me but will have no further liability or obligation.
Covid 19: If there is government legislation in force relating to Covid 19 which prevents your booking from going ahead I will refund all payment that you have made to me for the booking. This includes a full national lockdown as well as a regional lockdowns affecting either your address or that of Twll y Cae. If a guest is unable to leave home due to illness with Covid 19 the standard cancellation Terms and Conditions will apply. Purchasing holiday cancellation insurance is strongly recommended.
If you or a member of your party develops Covid 19 whilst at the property you should inform me and follow the government guidance in force at that time. If you or any member of your party are unable to leave the property on the previously agreed date, you will be required to pay my costs of cancelling subsequent bookings at the property that result from your extended stay.
Number of guests: Only you and your party, up to a maximum of 5 people in total, are allowed access to the property. Access by other parties may be permitted only with my written consent. If you breach these conditions I reserve the right to deny you and your party access to the property. Your booking will be considered void and you will not be entitled to a refund of your payment or any compensation from me.
Duration of stay: The property is only available for short term bookings and you may only remain at the property for the duration of the agreed booking period.
Arrival and departure: Arrival time is from 4pm on the first day and departure time is by 10am on the last day.
Dogs: Well behaved dogs are welcome at the property by prior arrangement. Please ensure their flea treatment is up to date prior to your arrival. Dogs are not allowed on furniture at the property and you are responsible for clearing up after your dog. You must provide your own dog bedding, food bowls and towels. I cannot guarantee that the garden areas are secure for dogs so they must be supervised at all times. Dogs must not be left unattended at the property and you are liable for any damage caused by your dog at the property.
No Smoking: No smoking is permitted inside the property and I ask you to clear any cigarette ends from outside areas.
Wi-fi: Free wi-fi internet connection is provided to guests for general access to the web and for reasonable use. By using this network you agree to use the internet fairly and appropriately and undertake to indemnify the owner of the property for any loss or damage that may result from your use of this internet facility.
Acceptable use: You must not use this internet connectivity services:
a) in any way that breaches any applicable local, national or international law or regulation;
b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
c) for the purpose of harming or attempting to harm minors in any way;
d) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
e) to knowingly transmit any data, send, upload or download any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
f) to be defamatory of any individual;
g) to promote obscene, offensive, hateful or inflammatory material;
h) to discriminate (including based on race, sex, religion, nationality, disability, sexual orientation or age)
i) in any way which infringes copyright, database right or trade mark;
j) to deceive any person
k) to breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence
l) to be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety
m) to harass, upset, embarrass, alarm or annoy any other person
n) to impersonate any person, or to misrepresent your identity or affiliation with any person
o) to give the impression that you are economically linked to us
p) to advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse or to access without authority, interfere with, damage or disrupt any equipment or devices connected to a network owned, controlled or used by us or any third party.
The use of the internet by a minor is subject to this policy and the consent of their parent or guardian. I advise parents/guardians who permit their children to use the internet connectivity that I provide, that it is important that they communicate with their children about safety online, as moderation is not foolproof.
Limitations to my liability: Neither a minimum speed, unrestricted bandwidth nor uninterrupted provision of access is guaranteed and I will not be liable for any form of compensation or expenses claimed by you in respect of the provision or quality of internet connectivity.
Provision of internet access by me is entirely discretionary and provided without guarantee. Failure of internet connectivity, or failure to provide internet connectivity (or sufficient bandwidth for any specific use) does not constitute a breach of any contract to provide you with accommodation.
I exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and I may take any other action I reasonably deem appropriate.
I exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our internet connectivity services or in connection with the use, inability to use, or results of the use of our services including loss of or damage to; income or revenue, business, profits or contracts, anticipated savings, data, or goodwill, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
I will not be liable for any loss or damage caused by viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your access to the internet via our services and it is recommended that you install anti virus and firewall software on your device before connecting.
Suspension and termination: I reserve the right to monitor network usage and report any illegal or prohibited activity.
I will determine, in my discretion, whether there has been a breach of this acceptable use policy through your use of our internet connectivity services. When a breach of this policy has occurred, I may take such action as I deem appropriate.
Failure to comply with this acceptable use policy constitutes a material breach and may result in my taking any or all of the following actions:
a) immediate, temporary or permanent withdrawal of your right to use our services;
b) issue of a warning to you;
c) legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
d) further legal action against you; and/or
e) disclosure of such information to law enforcement or other such authorities as we deem appropriate.
Your use of the internet connection provided is subject to your acceptance of these terms and those of my internet service provider; currently Talk Talk.
Electric vehicles: There is no specific charging point at the property (Twll y Cae) and I cannot currently facilitate electric vehicle charging as the circuit is not for that purpose or suitable for that level of electric load. Domestic chargers are not permitted at the property: most EVCs are provided with a domestic charger (known as a granny charger or trickle charger) which recharge the EV using a domestic power source via a 3 pin wall socket. It is forbidden to charge an electric vehicle through the domestic system at Twll y Cae as this would be unsafe and invalidate insurance. I retain the right to carry out reasonable inspection, on or without notice basis, to ensure that granny chargers are not in use at the property. You are solely liable for any damage or loss suffered as a result or your unauthorised use of domestic chargers. This policy applies to all members of the booking party and such other visitors to the property. It shall be the responsibility of the lead guest to inform all members of the booking party and any visitors of this policy.
Guests’ responsibility: You undertake to keep the property secure and take care of furniture and fittings provided at the property and subject these to normal use. Please report any loss, damage or failure of equipment to me immediately so I can arrange to resolve the problem. I may charge you for loss or damage. On departure you must leave the property clean and tidy. If special cleaning is required you will incur a charge. Towels must not be removed from the property. Aggressive or offensive behaviour towards neighbours or the owner will not be tolerated and I reserve the right to deny access to the property without refund or any other liability if I deem your behaviour to be unacceptable.
Owner’s access: You must allow me, or anyone representing me, access to the house and garden at any reasonable time by arrangement.
Liability: You are responsible for your own personal belongings and I accept no liability for any accident, loss or damage to property, persons, pets or vehicles or their contents whilst on the premises. I will not be responsible for failure of services beyond my control. Children and pets should be supervised at all times when at the property.
Lost property: I cannot accept responsibility for any items left at the property but will hold items for one month if found. If you ask I will try to return lost property but at your expense.
Complaints: You should report complaints or problems to me immediately to give me the opportunity to put things right. I undertake to do everything I reasonably can to resolve these.
Your personal details and data protection: I conduct my business in accordance with General Data Protection Regulations (GDPR). Please see my privacy policy for full details.
Accuracy of information: I try to ensure the accuracy of the information given to guests, including that in guest literature and on my website. I accept no liability for any services offered by third parties, amendments to local amenities or information given via links from my own website.
I aim to ensure the clarity and fairness of these Terms and Conditions and reserve the right to cancel any booking without compensation, refund or reimbursement if you breach the terms of these conditions. These Terms and Conditions may be updated from time to time.
